Bill Paxton Death: Wrongful Death

On Behalf of | Jun 2, 2018 | Wrongful Death

When actor Bill Paxton went in for heart surgery, he ended up, unfortunately, dying of a stroke. This lethal stroke is thought to have been triggered by heart surgery and his family is now suing the surgeon and hospital involved in his death.

The 61-year-old actor died due to these complications and his family has now filed a suit alleging improper surgery by the surgeon and that the actions of the hospital also led to the stroke Paxton suffered that ended his life.

The Allegations Of Medical Negligence Made By The Family

The coroner declared that the official reason for Paxton’s death was the stroke that occurred eleven days post-surgery. The heart operation was performed to replace a heart valve and repair an aortic aneurysm, a condition where there is a bulge in the aorta, which is the largest blood vessel in the body.

A stroke is a side effect of the surgery and by law should be explained to the patient by his medical team before the surgery occurs. The family claims that the risks were either not explained or made clear. They say that the surgeon “misrepresented or concealed” information about the risks of the surgery.

Alongside these allegations, there are also claims that the surgeon did not only not provide enough care after the stroke but also was not qualified enough to perform the surgery itself.

What Are Medical Malpractice And Wrongful Death?

If a death happens due to negligence from another party it is known as wrongful death. When this occurs the loved ones of the deceased can claim damages by filing a wrongful death claim. When this type of lawsuit is filed there must be enough evidence to prove that the deceased did not receive the right level of care required by the doctors, healthcare professionals, or hospital that lead to complications and death.
