Horrific C-Section Without Anesthesia

On Behalf of | Aug 10, 2018 | Medical Malpractice

Going to the hospital should mean you are in trusted hands. The building is full of trained professionals who know exactly what they’re doing and are expected to treat you with a duty of care. They have gone through years and years of schooling and have taken an oath. It’s safe to say that your health should be in high regard with them However, healthcare professionals are still human. They can still make mistakes or be neglectful. It’s not fair but it does happen. They didn’t follow through on the standard of care and now you’re the one harmed. You could potentially have some life-changing impacts because of their carelessness.

When you are pregnant, it is one of the most sensitive times of your life. You are carrying life after all and it’s important that doctors use caution and care when dealing with you and the new baby. It’s unfortunate that medical malpractice can be prominent before, during, and after childbirth.

A California couple is suing for a performed c-section without anesthesia. Delfina Mota was rushed to the ER for a c-section when she was at 41 weeks pregnant. No anesthesiologist was available, so she was forced to deliver the baby without drugs. Mota says the words from the obstetrician were “We have to just do it.”

Mota says that she felt the pain of them cutting her open. She eventually passed out due to the intense trauma. Mota and her boyfriend, Paul Iheanachor are now suing the hospital, the doctors for medical malpractice, and for assault and battery. In total, the couple is seeking over 5 million for damages. They say that their goal in these claims and the amount is to prevent future incidents from occurring. It may make the hospital think twice before making the same decision with another patient. The hospital staff proved they were negligent in their actions. They tried to cover it up by providing Mota with a $25 gift card and a double room.

It’s unfortunate that the mother has said she is still in pain 8 months after the procedure. The new parents claim that the incident even impacted the mother-baby bond. Mota is extremely traumatized by the event. She says that she suffers from PTSD (Post-Traumatic Stress Disorder) and is scared to have another baby. She also was unable to care for herself in the beginning as she could barely walk. The medical center has denied allegations

Medical malpractice is nothing you could’ve prepared for. You trusted that the healthcare professionals knew what they were doing and would not cause you intentional harm. Now you have to deal with the consequences because of their negligence. Many other people went through this same scenario. You aren’t alone. You expected to come out feeling better or cured but instead, you came out injured. Or your loved one died in the process. You need someone with years of experience on your side. The last thing you need is more stress. Contact Licata & Yeremenko, A Professional Law Corporation in California for a free consultation at 818-783-5757.
