At a hearing on Tuesday, April 3, a New Jersey federal judge rejected a number of claims from a putative class action against Maibec Inc., relating to allegedly defective wood shingles. Some of the claims were pared from the class action on the grounds of the wood shingles having been purchased by contractors working for the clients, meaning the clients had never entered a contract with the manufacturer and, as such, were not entitled to the breach of contract claims they had filed. Two of the class claims were dismissed on this basis, with one more being rejected due to missing the deadline imposed by the statute of limitations, and yet another plaintiff being told she had no evidence that her contractor was acting as her agent when making the purchase.
