Wrongful Death: Defending Your Loved One

On Behalf of | Jan 26, 2019 | Wrongful Death

There is no easy way to live life after you realize that a loved one has passed away. It is always how that makes it so much worse than just knowing that they are gone. The top three reasons why most young adults die are accidents, suicides, and homicides. Accidents are typically car accidents with a range of situations causing car accidents. Suicide is second which is where a young person believes that they have no way out of a dire situation and takes their own life. The third is a homicide in which the majority of homicides were committed with a firearm. Gun violence is on the rise and without taking the proper avenues to seek justice, the problem will only get bigger.

Such is the case for a family in Los Angeles whose son died due to a gunshot wound. The son was profiled for shoplifting when there was no evidence. He was fatally shot in the back of the neck. At the time, the young man, 21, was homeless and was known as “Sky Young”. He was shot by a security guard who even confessed that Sky Young did not shoplift. The young man was defenseless and did not cause behavior that would warrant such actions. From what we know from the public record, the security may show negligence in handling the situation. Wrongful death is when a person’s death results in the negligent behavior of a person or a party. In this case, the security guard was negligent in shooting the young man and Walgreens may be responsible for hiring such aggressive security guards.

The family is suing Walgreens for wrongful death and the security is accused of manslaughter. If you are in a situation in which your loved one has died to the negligence of someone or some party then not only can you press criminal charges, but you can also file a civil suit. Filing these two suits does not affect the outcome of each other. You can have these two suits at the same time, but more than likely a wrongful death civil suit is filed after a criminal suit has been completed.

The family is suing Walgreens for $525 million dollars. A wrongful death civil suit is brought on to cover financial losses such as funeral expenses, medical expenses, loss of wages, and pain and suffering. Bringing forth a wrongful death suit you must be a close family member.
