What Does Age Discrimination In The Workplace Look Like?

The U.S. Equal Employment Opportunity Commission (EEOC) defines age discrimination as “treating an applicant or employee less favorably because of his or her age.”

More specifically, the EEOC delves into the Age Discrimination in Employment Act (ADEA) to show us that this law forbids discrimination against people who are aged 40 or over. In California, these protections are afforded through the Fair Housing and Employment Act (FEHA). Notably, this law does not protect individuals under the age of 40.

There are various ways in which age discrimination can manifest in the workplace. However, in reality, it is rare for supervisors, managers, and/or employers to carry out this type of discrimination in an open and obvious manner (for example derogatory comments or jokes about older persons). This means that employees need to be on the lookout for signs of being treated differently because of their age. In many cases, long-term employees experience age discrimination, even if they had an excellent career with their employer.

Some of the ways that age discrimination can occur in the workplace include the following:

  • Termination or layoffs specifically targeting older workers
  • Being persuaded by supervisors or management personnel to retire
  • Questions and/or comments about the employee’s age and/or about retirement
  • Not being interviewed, hired, and/or promoted because of age
  • Workplace harassment or insults related to age
  • Employers purposely making jobs more strenuous to encourage older employees to quit as well as the implementation of “new and exciting” technologies making it difficult for older employees to perform the necessary work assignments older employees being offered lower pay, reduced benefits, or less favorable job assignments
  • Older employees facing disciplinary actions (i.e., verbal/written warnings, suspensions, demotions, terminations) while younger workers are not disciplined for similar conduct/errors/mistakes
  • Older workers being replaced by younger, less experienced workers
